We help our clients secure clean, safe, and reliable water supplies for water and wastewater service providers; we help public utilities, developers, and industrial clients obtain state and federal permits necessary to construct essential projects in sensitive environments; we defend permits against any and all challenges; we defend environmental citizen suits and help our clients avoid them; and we help our clients identify and minimize legals risks and delays as they plan for the future.
We have extensive experience with the Clean Water Act and the U.S. Army Corps of Engineers’ civil works and regulatory programs, including Section 404 and Section 408 permits, the NEPA process for major infrastructure developments, mitigation banks, water supply projects, and the use and modification of federal water projects operated by the U.S. Army Corps of Engineers. We represent many local governments and water providers on issues related to water supply and water rights, wastewater permitting, water quality standards, regulatory compliance, long-term planning, and rate-setting. We have also represented many clients on reservoir licensing issues before the Federal Energy Regulatory Commission (FERC), and on endangered species issues involving the U.S. Fish and Wildlife Service.
